Terms and Conditions

These Terms govern use of the CardTrade Network marketplace. The platform is built to help users trade with each other, not to step into the place of the buyer, seller, courier, or insurer.

CardTrade Network is a marketplace platform only. Buyers and sellers contract directly with each other. We do not own listed items, inspect every item, take custody of parcels, or guarantee delivery, authenticity, grading, legality, or seller performance.

Loss, theft, damage, non-delivery, wrong-item delivery, counterfeit, condition, authenticity, and shipping disputes remain the responsibility of the buyer and seller unless we expressly provide a written remedy for a specific case.

Until we explicitly launch a separate written protection or insurance product, the platform does not insure parcels, transactions, or user losses and does not absorb shipping risk by default.

We may place holds, cancel, reverse, limit, correct, offset, claw back, or unwind listings, payments, payouts, balances, shipping workflows, and account actions where we detect errors, fraud, abuse, policy breaches, payment risk, legal risk, or platform issues.

1. Platform role only

CardTrade Network provides marketplace infrastructure that helps users list, discover, buy, sell, and communicate about trading-card products and related items.

CardTrade Network is not the seller, buyer, carrier, warehouseman, authenticator, grader, insurer, escrow agent, fiduciary, or agent of any user unless it expressly agrees otherwise in writing for a specific service.

Each sale is concluded directly between the buyer and the seller. Platform tools such as payments, moderation, messaging, fraud screening, shipping workflows, and dispute handling do not make CardTrade Network a party to the underlying sale contract between users.

2. User responsibility

Sellers are responsible for the accuracy, legality, ownership, condition description, authenticity, pricing, availability, packaging, dispatch, and fulfilment of their listings and orders.

Buyers are responsible for reviewing listing details, edition, language, condition, quantity, shipping method, fees, and suitability before completing a purchase.

Each user is responsible for that user's own conduct, content, representations, communications, and dealings with other users.

Users must not list stolen goods, counterfeit goods, goods they do not have authority to sell, or goods that infringe any third-party rights or applicable law.

3. No guarantee of users or outcomes

CardTrade Network does not guarantee that any user is trustworthy, solvent, authorised, or able to complete a transaction.

CardTrade Network does not guarantee that any listing is accurate, lawful, authentic, available, or fit for a buyer's purpose.

Risk-reduction controls such as verification, fraud screening, moderation, reserves, or dispute tools are safeguards only. They reduce risk but do not eliminate it.

4. Shipping, collection, loss, and damage

Risk relating to packing, dispatch, transit, collection, delivery, non-delivery, theft, tampering, delay, loss, and damage remains between the buyer and seller unless CardTrade Network expressly states otherwise in writing for a specific transaction.

If users choose untracked shipping, informal handoff, third-party courier arrangements, locker collection, or any off-platform variation, they do so at their own risk.

CardTrade Network may require tracked shipping, proof of dispatch, proof of delivery, packaging evidence, or identity checks before making a platform decision, but that does not transfer shipping risk to the platform.

A tracking number, courier quote, platform-generated shipping workflow, or delivery-status update is a tool for managing a transaction and is not a platform guarantee that the parcel will arrive or that a courier will perform correctly.

5. No insurance or platform-backed loss absorption

Unless CardTrade Network launches a separately described written product, nothing on the platform constitutes insurance, shipping insurance, a performance guarantee, financial advice, or an undertaking to absorb user losses.

Any goodwill credit, discretionary refund, or case-specific support measure is voluntary, revocable before payment, and does not create a precedent or ongoing obligation.

Users must not describe any platform remedy, dispute process, or shipping workflow as insurance unless CardTrade Network has expressly named that specific product as insurance in writing.

6. Holds, reversals, corrections, and cancellations

CardTrade Network may refuse, pause, limit, cancel, reverse, unwind, correct, or reject any listing, payment flow, payout, withdrawal, shipment workflow, or account action where it reasonably believes this is necessary for marketplace safety, operational integrity, legal compliance, fraud prevention, payment risk management, or technical remediation.

CardTrade Network may debit, set off, claw back, or withhold funds from current or future payouts where it reasonably believes a refund, reversal, chargeback, adjustment, fee, penalty, reimbursement, or recovery is due.

Users acknowledge that platform actions can be reversed or corrected where caused by mistake, technical fault, system abuse, policy breach, legal risk, or marketplace integrity concerns.

CardTrade Network may take urgent action without prior notice where advance notice would create risk, allow evidence to be altered, expose users to harm, or undermine fraud prevention, payment risk management, or legal compliance.

7. Disputes and platform remedies

CardTrade Network may investigate complaints, request evidence, delay payout, place funds on hold, freeze account functionality, remove content, cancel listings, pause orders, and make provisional platform decisions where necessary to protect the marketplace.

CardTrade Network is not required to reimburse either party merely because a dispute exists.

Some disputes may need to be resolved directly between users or escalated to a payment provider, courier, regulator, law-enforcement agency, tribunal, or court.

Users must cooperate honestly and promptly with dispute handling and must provide reasonable evidence on request, including photographs, messages, receipts, proof of ownership, proof of dispatch, proof of delivery, packaging evidence, and identity or account information where relevant.

Failure to cooperate, preserve evidence, or provide requested information may result in a claim being denied, a payout being delayed, a listing being removed, or an account being restricted.

8. Liability limits

To the maximum extent permitted by law, CardTrade Network is not liable for losses caused by the acts or omissions of buyers, sellers, couriers, payment providers, or other third parties.

To the maximum extent permitted by law, CardTrade Network is not liable for lost, stolen, delayed, damaged, tampered with, misdelivered, or undelivered items, or for counterfeit, grading, condition, authenticity, or legality disputes between users.

Nothing in these Terms excludes, restricts, or limits any right or remedy that cannot lawfully be excluded, restricted, or limited under applicable law.

If CardTrade Network is found liable despite these limitations, its aggregate liability for a marketplace-services claim will, to the maximum extent permitted by law, be limited to the platform fees actually paid to CardTrade Network for the transaction giving rise to the claim.

9. Account restrictions and enforcement

CardTrade Network may warn, throttle, limit, freeze, suspend, terminate, or permanently restrict any account, listing, payout, withdrawal, trust signal, verification status, benefit, or marketplace privilege where it reasonably suspects risk to users, the platform, service providers, or the law.

Examples include suspected fraud, attempted fraud, collusion, chargeback abuse, counterfeit activity, sale of stolen goods, lack of authority to sell, review manipulation, dispute manipulation, identity misuse, multi-account abuse, ban evasion, payment risk, abusive conduct, or circumvention of platform controls.

CardTrade Network may preserve evidence and, where legally permitted or required, share information with payment providers, couriers, regulators, law-enforcement bodies, affected users, or professional advisers.

10. Fees, payouts, reserves, and set-off

Seller marketplace fees are currently 10% for approved brick and mortar stores, 12.5% for approved online stores, and 15% for private sellers, unless CardTrade Network approves a written override for a specific seller.

Platform fees, payment-provider fees, courier charges, chargeback costs, penalties, reversals, refunds, and other recoveries may be deducted from amounts payable to a user where they relate to that user, that user's transaction, or that user's conduct.

Seller proceeds are conditional until the relevant order, payment, dispute, chargeback, courier issue, fraud review, and compliance checks are sufficiently resolved in CardTrade Network's reasonable view.

CardTrade Network may hold reserves or delay payout timing for accounts, transactions, categories, or risk profiles where this is needed for payment risk management, dispute handling, fraud prevention, regulatory compliance, or platform integrity.

11. User indemnity

Each user indemnifies CardTrade Network and its affiliates, officers, employees, contractors, and service providers against claims, losses, liabilities, penalties, fines, damages, costs, and expenses arising from that user's listings, content, transactions, representations, conduct, breach of these Terms, or infringement of third-party rights.

This indemnity includes claims relating to tax, customs, consumer protection, privacy, intellectual property, shipping, payments, chargebacks, counterfeit goods, stolen goods, prohibited goods, and disputes between users, to the extent permitted by law.

12. Service and terms changes

CardTrade Network may change features, workflows, eligibility rules, verification rules, fees, categories, shipping options, payout timing, dispute processes, trust signals, enforcement logic, and these Terms from time to time, subject to applicable law.

Where a change materially affects user rights or obligations, CardTrade Network will take reasonable steps to make the updated Terms available and draw attention to the change through the platform or another appropriate channel.

Continued use of the marketplace after updated Terms take effect constitutes acceptance of those updated Terms, except where applicable law requires a different process.

13. Mandatory rights and severability

These Terms must be read subject to applicable South African law, including consumer, electronic communications, privacy, payment, and financial-services laws where they apply.

Nothing in these Terms excludes, restricts, limits, or requires a user to waive any right, remedy, representation, guarantee, warranty, liability, or obligation that cannot lawfully be excluded, restricted, limited, or waived.

If a provision is unenforceable, it will be interpreted as narrowly as necessary or severed to the extent required, without affecting the enforceability of the remaining Terms.
